Notices issued on plea against 'unlawful' postings at LUH.

HYDERABAD -- A division bench of Sindh High Court's Hyderabad circuit comprising Justice Mohammad Iqbal Kalhoro and Justice Mohammad Saleem Jessar on Tuesday issued notices to respondents on a petition challenging appointments of Liaquat University Hospital's director administration, accounts and development and chief pathologist.

The petitioner, Advocate Mohammad Amir Pervaiz, has cited the chief secretary, health secretary, Liaquat University of Medical and Health Sciences (LUMHS) vice chancellor and LUH medical superintendent, besides the director, Abdul Sattar Jatoi, and chief pathologist, Dr Dasrath Shardha, as respondents. The hearing has been fixed for Nov 24.

Additional Advocate General (AAG) Sindh was also put on notice.

The petitioner submitted in court that he was filing the petition as pro bono public after having learnt about corruption and embezzlement in LUH departments.

He stated that respondent Abdul Sattar Jatoi was holding the position of secretary of the LUH management board. He was appointed in the health department as planning officer (BS-17) and promoted in BS-19 on Jan 27, 2010, added the petitioner.

Advocate Pervaiz recalled that Mr Jatoi was promoted in BS-20 unlawfully by creating a new post. Following the respondent's promotion in BS-20, his batch mate, Ali Abbas, had moved an appeal (1009/2019) in the Sindh Service Tribunal at Karachi and after hearing parties at length, the tribunal mentioned in para No.12 of its order that 'present is a unique case of favouritism and nepotism and that too in violation of judgment of Supreme Court in civil review petition No. 193/2013'. The appeal was decided on Sept 22, 2020 and the promotion was set aside. The respondent director challenged the tribunal's order in Supreme Court vide civil appeal No. 1167/2020 which was dismissed on Jan 10, 2022.
